Au fond, rien de nouveau mais l&rsquo;\u00e9tude a le b\u00e9n\u00e9fice de mettre quelques chiffres sur des \u00e9vidences :\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>63% des salari\u00e9s interrog\u00e9s se disent d\u00e9\u00e7us des augmentations<\/b><span style=\"font-weight: 400;\"> annuelles octroy\u00e9es par leur employeur<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>67% des salari\u00e9s<\/b><span style=\"font-weight: 400;\"> ont des <\/span><b>augmentations nulles<\/b><span style=\"font-weight: 400;\"> (30%) ou <\/span><b>inf\u00e9rieures<\/b><span style=\"font-weight: 400;\"> \u00e0 leurs attentes (37%)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>89%<\/b><span style=\"font-weight: 400;\"> des salari\u00e9s estiment qu\u2019ils <\/span><b>m\u00e9ritent une augmentation<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">Et c\u2019est pr\u00e9cis\u00e9ment cette disparit\u00e9 entre les attentes et les augmentations effectives qui impacte n\u00e9gativement les salari\u00e9s : 74% consid\u00e8rent qu\u2019il s\u2019agit <\/span><b>d\u2019un manque de respect de l\u2019entreprise<\/b><span style=\"font-weight: 400;\"> envers leur implication et leur travail, 35% l&rsquo;interpr\u00e8tent comme <\/span><b>une incitation \u00e0 la d\u00e9mission<\/b><span style=\"font-weight: 400;\"> et pour 31% c\u2019est<\/span><b> le pr\u00e9texte qu\u2019ils attendaient pour poser leur dem\u2019<\/b><span style=\"font-weight: 400;\">. D\u00e9sormais,<\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/actualites\/A16740\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> l\u2019absence d&rsquo;acceptation claire par le salari\u00e9 d&rsquo;une sanction disciplinaire vaut refus.<\/span><\/a> <span style=\"font-weight: 400;\"><strong>L\u2019employeur peut ainsi prononcer une nouvelle sanction comme, au hasard, un licenciement<\/strong>. A l\u2019origine de ce texte de loi, un employeur qui propose \u00e0 son salari\u00e9 une r\u00e9trogradation disciplinaire avec modification de son contrat de travail. Le salari\u00e9 accepte la proposition mais refuse le qualificatif de sanction disciplinaire. Ce refus entra\u00eene son licenciement pour faute grave et ce dernier fait appel.<\/span><\/p><p><span style=\"font-weight: 400;\">Mais, retournement de situation, la cour d\u2019appel rejette sa requ\u00eate consid\u00e9rant que <strong>le salari\u00e9 a donn\u00e9 une r\u00e9ponse ambig\u00fce \u00e0 la proposition faite par l\u2019employeur<\/strong>. Elles regrettent notamment d\u2019\u00eatre l\u00e0 pour <\/span><b>ex\u00e9cuter des ordres et de voir se g\u00e9n\u00e9raliser des approches tr\u00e8s anglo-saxonnes du m\u00e9tier<\/b><span style=\"font-weight: 400;\">. C\u2019est-\u00e0-dire pragmatiques et efficaces.<\/span><\/p><p><span style=\"font-weight: 400;\">Outre-Manche et Outre-Atlantique, l\u00e0 o\u00f9 ces pratiques ont depuis longtemps cram\u00e9 les fonctions RH par les deux bouts, l\u2019heure n\u2019est plus aux lamentations mais \u00e0 la riposte. Plusieurs d\u00e9cennies de pragmatisme et d\u2019efficacit\u00e9, \u00e7a laisse des traces et <\/span><b>c\u2019est sur Instagram que la parole se lib\u00e8re<\/b><span style=\"font-weight: 400;\">. La combine est sophistiqu\u00e9e : il suffit d\u2019ignorer copieusement les recruteurs au beau milieu du processus de recrutement.
