Un refus sans motif l\u00e9gitime peut constituer une faute et justifier un licenciement.<\/p><\/li><li><p class=\"text-text-05 font-main-content-body\"><strong>Exception : le consentement obligatoire dans 3 cas.<\/strong>\u00a0L&rsquo;accord \u00e9crit du salari\u00e9 est requis si la formation se d\u00e9roule hors horaires habituels, s&rsquo;il s&rsquo;agit d&rsquo;un bilan de comp\u00e9tences ou d&rsquo;une validation d&rsquo;acquis, ou si elle vise un titre\/dipl\u00f4me.<\/p><\/li><li><p class=\"text-text-05 font-main-content-body\"><strong>Motifs l\u00e9gitimes de refus : formation d\u00e9connect\u00e9e du contrat ou discriminatoire.<\/strong>\u00a0Le salari\u00e9 peut refuser si la formation modifierait son contrat de travail sans son accord, s&rsquo;\u00e9loignerait excessivement de ses obligations familiales, ou si elle constitue une entrave \u00e0 un mandat syndical.<\/p><\/li><li><p class=\"text-text-05 font-main-content-body\"><strong>Sanctions possibles : du licenciement \u00e0 la faute grave<\/strong>. Un refus sans motif l\u00e9gitime peut entra\u00eener un avertissement, une mise \u00e0 pied, une r\u00e9trogradation ou un licenciement. Dans certains cas exceptionnels, le refus peut \u00eatre qualifi\u00e9 de faute grave.<\/p><\/li><li><p class=\"text-text-05 font-main-content-body\"><strong>Recommandation RH : informer en amont et documenter<\/strong>.
