elementor-size-default\">Offrir des actions de formation<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7644563 elementor-widget class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Les actions de formation qui conditionnent l\u2019exercice d\u2019une activit\u00e9 ou d\u2019une fonction sont obligatoires. Celles-ci peuvent \u00eatre regroup\u00e9es dans un plan de d\u00e9veloppement de comp\u00e9tences (anciennement plan de formation) :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">formation pour l\u2019adaptation au poste de travail ou le maintien de l\u2019employabilit\u00e9 au regard des \u00e9volutions de l\u2019emploi, des technologies et de l\u2019organisation ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">formation pour la s\u00e9curit\u00e9 au travail et la sant\u00e9 des collaborateurs ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">formation en cas de suppression de poste et de mutation professionnelle ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">formations pr\u00e9vues par la convention collective ou le contrat de travail.<\/span><\/li>\n<\/ul>\n<div>\u00a0<\/div>\n<p><span style=\"font-weight: 400;\">En contrepartie, le collaborateur doit s\u2019engager \u00e0 suivre les actions de formation qui lui sont pr\u00e9sent\u00e9es, sauf dans certains cas. <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/talents\/competences-carrieres\/refus-formation-salarie\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">D\u00e9couvrez les motifs recevables de refus du salari\u00e9.\u00a0<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019entreprise est \u00e9galement tenue d\u2019offrir au moins une action de formation non obligatoire tous les 6 ans \u00e0 ses collaborateurs.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e42daa2 elementor-widget elementor-widget-heading\" data-id=\"e42daa2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Financer la formation professionnelle et l\u2019alternance<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f13d8d6 elementor-widget elementor-widget-text-editor\" data-id=\"f13d8d6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Les formations obligatoires cit\u00e9es ci-dessus doivent \u00eatre financ\u00e9es par l\u2019employeur et r\u00e9alis\u00e9es pendant les heures de travail, except\u00e9 les formations certifiantes qui rentrent dans le cadre du plan de d\u00e9veloppement de comp\u00e9tences d\u2019un salari\u00e9 : celles-ci peuvent \u00eatre financ\u00e9es via le dispositif CPF.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Par ailleurs, la loi du 5 septembre 2018 impose une contribution financi\u00e8re unique de la part des employeurs, dont la somme d\u00e9pend de l\u2019effectif de l\u2019entreprise et de sa masse salariale. Depuis 2022, cette contribution est vers\u00e9e \u00e0 l\u2019Urssaf et sert \u00e0 financer les actions de formations des entreprises de moins de 50 salari\u00e9s ainsi que les formations en alternance.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-72efdc8 elementor-widget elementor-widget-heading\" data-id=\"72efdc8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Offrir des perspectives d\u2019\u00e9volution professionnelle\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c240ca7 elementor-widget elementor-widget-text-editor\" data-id=\"c240ca7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Toutes les entreprises ont l\u2019obligation de r\u00e9aliser des entretiens professionnels tous les 2 ans et un bilan \u00e0 6 ans pour faire le point sur le plan de carri\u00e8re de chaque collaborateur. Depuis le 5 septembre 2018, le bilan \u00e0 6 ans est \u00e9galement l\u2019occasion de contr\u00f4ler qu\u2019une formation non obligatoire leur a \u00e9t\u00e9 dispens\u00e9e.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les entreprises d\u2019au moins 50 salari\u00e9s s\u2019exposent \u00e0 des <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/talents\/competences-carrieres\/obligations-formation-employeur\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sanctions en cas de manquement<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Celles de moins de 50 salari\u00e9s ne sont pas sanctionn\u00e9es, cependant chaque collaborateur est en mesure de demander la r\u00e9paration du pr\u00e9judice au tribunal.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6dbfbd elementor-widget elementor-widget-heading\" data-id=\"a6dbfbd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Droit \u00e0 la formation du salari\u00e9 : les dispositifs actionnables\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9809353 elementor-widget elementor-widget-text-editor\" data-id=\"9809353\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400\">Les collaborateurs d\u00e9sireux d\u2019\u00e9voluer professionnellement ont acc\u00e8s \u00e0 divers dispositifs que nous vous d\u00e9taillons ci-dessous.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fa0310b elementor-widget elementor-widget-heading\" data-id=\"fa0310b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Le CPF, ou Compte Personnel de Formation<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fc3b66c elementor-widget elementor-widget-text-editor\" data-id=\"fc3b66c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Le CPF de chaque collaborateur travaillant au minimum \u00e0 mi-temps est cr\u00e9dit\u00e9 chaque ann\u00e9e de 500 euros et plafonn\u00e9 \u00e0 5000 euros. Les salari\u00e9s les moins qualifi\u00e9s ou en situation de handicap re\u00e7oivent quant \u00e0 eux 800 euros par an dans la limite de 8000 euros.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le CPF est uniquement mobilisable par le collaborateur, \u00e9ventuellement durant les heures de travail sous r\u00e9serve de l\u2019accord de l\u2019employeur.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-39beeee elementor-widget elementor-widget-heading\" data-id=\"39beeee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Le PTP, ou Projet de Transition Professionnelle<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ef11564 elementor-widget elementor-widget-text-editor\" data-id=\"ef11564\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400\">Un collaborateur souhaitant r\u00e9aliser une reconversion professionnelle peut faire une demande de PTP, ou CPF de transition, aupr\u00e8s de l\u2019association Transitions Pro. Il doit au pr\u00e9alable demander une autorisation d\u2019absence aupr\u00e8s de son employeur.\u00a0<\/span><\/p><p><span style=\"font-weight: 400\">Le projet n\u2019est accord\u00e9 qu\u2019aux salari\u00e9s en CDI ou en CDD justifiant d\u2019une anciennet\u00e9 d\u2019au moins deux ans, cons\u00e9cutifs ou non. <\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F14018\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Il est r\u00e9mun\u00e9r\u00e9 par l\u2019employeur<\/span><\/a><span style=\"font-weight: 400\"> s\u2019il est r\u00e9alis\u00e9 durant les heures de travail.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2488385 elementor-widget elementor-widget-heading\" data-id=\"2488385\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Le dispositif Pro-A<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d129689 elementor-widget elementor-widget-text-editor\" data-id=\"d129689\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Ce dispositif, cr\u00e9\u00e9 en 2018, permet aux collaborateurs souhaitant se reconvertir ou grimper d\u2019un \u00e9chelon d\u2019obtenir une qualification reconnue via l\u2019alternance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Il peut \u00eatre activ\u00e9 par le collaborateur ou l\u2019employeur dans le cadre d\u2019un plan de d\u00e9veloppement des comp\u00e9tences. Dans ce dernier cas, l\u2019entreprise peut obtenir une aide financi\u00e8re aupr\u00e8s de l\u2019OPCO de sa branche professionnelle.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c20376 elementor-widget elementor-widget-spacer\" data-id=\"3c20376\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div 400;\">Plusieurs cong\u00e9s peuvent \u00eatre accord\u00e9s \u00e0 un collaborateur selon la nature de l\u2019absence :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">cong\u00e9 pour examen en vue d\u2019obtenir une certification ou un dipl\u00f4me (notamment dans le cadre d\u2019un <\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2401\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">VAE<\/span><\/a><span style=\"font-weight: 400;\">) ;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">cong\u00e9 de formation des cadres et animateurs de jeunesse ;<\/span><\/li>\n<li style=\"font-weight:
