Les personnes int\u00e9ress\u00e9es peuvent alors acc\u00e9der librement \u00e0 leurs donn\u00e9es, en demander une copie et les rectifier si besoin.<\/span><\/li><li aria-level=\"1\"><span style=\"font-weight: 400;\">responsabiliser les organismes qui traitent des donn\u00e9es personnelles en mati\u00e8re de transparence et de s\u00e9curit\u00e9.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f216894 elementor-widget elementor-widget-heading\" data-id=\"f216894\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Quel lien avec la base de donn\u00e9es RH ?\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e9a0e4 elementor-widget elementor-widget-text-editor\" data-id=\"1e9a0e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Comme la base de donn\u00e9es RH comprend des donn\u00e9es personnelles des collaborateurs, elle entre dans le domaine de comp\u00e9tence du RGPD.<\/span><\/p><p><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Vous devez r\u00e9diger un document qui explique votre politique de confidentialit\u00e9 en mati\u00e8re de processus de r\u00e9colte des donn\u00e9es. Vous devez ensuite le mettre \u00e0 disposition des salari\u00e9s.<\/span><\/p><p><span style=\"font-weight: 400;\">Cette politique de confidentialit\u00e9 doit notamment pr\u00e9ciser les \u00e9l\u00e9ments suivants :<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/p><ul><li aria-level=\"1\"><span style=\"font-weight: 400;\">la dur\u00e9e de conservation des donn\u00e9es ;<\/span><\/li><\/ul><ul><li aria-level=\"1\"><span style=\"font-weight: 400;\">les moyens mis en place pour assurer la s\u00e9curit\u00e9 et l\u2019inviolabilit\u00e9 des donn\u00e9es RH ;<\/span><\/li><\/ul><ul><li aria-level=\"1\"><span style=\"font-weight: 400;\">le registre de toutes les actions men\u00e9es en mati\u00e8re d\u2019utilisation de ces donn\u00e9es ;<\/span><\/li><\/ul><ul><li aria-level=\"1\"><span style=\"font-weight: 400;\">les mesures \u00e0 adopter en cas de vol ou de piratage des donn\u00e9es ;<\/span><\/li><li aria-level=\"1\"><span style=\"font-weight: 400;\">la liste des personnes qui ont acc\u00e8s \u00e0 la base de donn\u00e9es.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e055455 elementor-widget elementor-widget-heading\" data-id=\"e055455\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Que se passe-t-il en cas de non-respect du RGPD ?\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3773336 elementor-widget elementor-widget-text-editor\" data-id=\"3773336\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">C\u2019est le Code p\u00e9nal qui y r\u00e9pond en son <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042193566\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">article 226-1<\/span><\/a><span style=\"font-weight: 400;\">. Celui-ci pr\u00e9voit notamment une sanction pouvant aller jusqu\u2019\u00e0 un emprisonnement de 5 ans et une amende de 300\u00a0000 euros en cas de d\u2019utilisation \u00e0 mauvais escient des donn\u00e9es.<\/span><\/p><p><span style=\"font-weight: 400;\">Il est en effet interdit de :<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/p><ul><li aria-level=\"1\"><span style=\"font-weight: 400;\">Diffuser les donn\u00e9es \u00e0 des personnes autres que celles mentionn\u00e9es dans la politique de confidentialit\u00e9 ;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li aria-level=\"1\"><span style=\"font-weight: 400;\">Utiliser les donn\u00e9es personnelles sans obtenir le consentement de la vie professionnelle de votre collaborateur.<\/span><\/p><p><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Il faut toutefois savoir que la CNIL (Commission nationale de l\u2019information et des libert\u00e9s) oblige les employeurs \u00e0 ne recueillir que les donn\u00e9es qui lui sont strictement n\u00e9cessaires.<\/span><\/p><p>\u00a0<\/p><p><span
