de sa r\u00e9mun\u00e9ration. Quand un salari\u00e9 est en \u00ab cong\u00e9 pay\u00e9 \u00bb, il per\u00e7oit une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s \u00e0 la date habituelle de paiement du salaire.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Le Code du travail encadre la prise des jours de cong\u00e9s pay\u00e9s. Il stipule que les salari\u00e9s cumulent au choix :\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">2,5 jours ouvrables par mois, soit 30 jours ouvrables par an <\/span><em><strong>ou<\/strong><\/em><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">2,08 jours ouvr\u00e9s par mois, soit 25 jours ouvr\u00e9s par an.\u00a0<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Sur une p\u00e9riode de 12 mois, avec un temps de travail effectif \u00e0 100%, cela correspond \u00e0 5 semaines de cong\u00e9s pay\u00e9s.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">La loi pr\u00e9voit une m\u00e9thode de d\u00e9compte en jours ouvrables, mais la convention collective peut privil\u00e9gier un calcul en jours ouvr\u00e9s. Les cong\u00e9s pay\u00e9s s\u2019acqui\u00e8rent chaque mois durant une p\u00e9riode de r\u00e9f\u00e9rence qui court du 1er juin au 31 mai de l\u2019ann\u00e9e suivante, sauf exception.<\/span><\/p><p><span style=\"font-weight: 400;\">Les salari\u00e9s doivent solder leurs cong\u00e9s pay\u00e9s au plus tard le 31 mai de l\u2019ann\u00e9e suivant la p\u00e9riode de r\u00e9f\u00e9rence, au risque de les perdre. Ainsi, les jours de cong\u00e9 qui n\u2019ont pas \u00e9t\u00e9 pris par le salari\u00e9 durant la p\u00e9riode de r\u00e9f\u00e9rence sont perdus.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">N\u00e9anmoins, certaines entreprises accordent un droit au report des cong\u00e9s pay\u00e9s non pris, ou offrent \u00e0 ses salari\u00e9s la possibilit\u00e9 de les transf\u00e9rer vers un Compte \u00c9pargne Temps (CET). Le Code du travail accorde \u00e9galement quelques situations exceptionnelles, o\u00f9 les cong\u00e9s pay\u00e9s peuvent \u00eatre report\u00e9s (exemple : salari\u00e9 en arr\u00eat longue elementor-size-default\">Que doit mentionner la fiche de paie d\u2019un salari\u00e9 en cong\u00e9s pay\u00e9s ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element un certain nombre de mentions obligatoires, notamment les <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/administration\/paie\/exoneration-fiscale-heures-supplementaires\"><span style=\"font-weight: 400;\">heures suppl\u00e9mentaires exon\u00e9r\u00e9es<\/span><\/a><span style=\"font-weight: 400;\">, les taux et montants des cotisations et contributions sociales, la r\u00e9mun\u00e9ration nette, etc.<\/span><\/p><p><span style=\"font-weight: 400;\">Le bulletin de salaire doit \u00e9galement faire mention des cong\u00e9s pris quand il y en a eu sur la p\u00e9riode en question.<\/span><\/p><p><span style=\"font-weight: 400;\">Ainsi, en dessous du salaire de base, la fiche de paie doit mentionner :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le nombre de jours de cong\u00e9s pay\u00e9s pris sur le mois en question,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les dates des cong\u00e9s pay\u00e9s,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s vers\u00e9e.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Ces trois \u00e9l\u00e9ments permettent aux salari\u00e9s de valider les \u00e9l\u00e9ments saisis par l\u2019employeur et de v\u00e9rifier le montant de l\u2019indemnit\u00e9 compensatrice vers\u00e9e pendant leur p\u00e9riode de repos.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div style=\"font-weight: 400;\">La loi pr\u00e9voit un d\u00e9lai l\u00e9gal minimum durant lequel il doit conserver un double des bulletins de paie de ses collaborateurs en format num\u00e9rique ou papier.<\/span><\/p><p><span style=\"font-weight: 400;\">Conform\u00e9ment \u00e0 la loi, l\u2019employeur est tenu de conserver les bulletins de salaire pendant au moins 5 ans.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Pour les bulletins de paie au format num\u00e9rique, l\u2019employeur doit les mettre \u00e0 disposition des salari\u00e9s pendant 50 ans ou jusqu\u2019\u00e0 6 ans apr\u00e8s le d\u00e9part \u00e0 la retraite du salari\u00e9.<\/span><\/p><p><span style=\"font-weight: 400;\">Ces d\u00e9lais commencent \u00e0 courir \u00e0 partir de la date de transmission de la fiche de paie au salari\u00e9.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Et cette obligation n\u2019est pas \u00e0 prendre \u00e0 la l\u00e9g\u00e8re : lors d\u2019un contr\u00f4le de l\u2019inspection du travail, l\u2019employeur doit \u00eatre en mesure de fournir le double des bulletins de paie de l\u2019ensemble de ses
