d\u2019\u00e9volution et ses besoins en formation, en ad\u00e9quation avec la strat\u00e9gie de l\u2019entreprise.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Encadr\u00e9 par la <\/span><span style=\"font-weight: 400;\">loi, l\u2019entretien professionnel<\/span><span style=\"font-weight: 400;\"> doit r\u00e9pondre \u00e0 certaines dispositions l\u00e9gales, notamment en class=\"elementor-heading-title elementor-size-default\">Qu\u2019est-ce qu\u2019un entretien professionnel obligatoire ? \n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e9ef13b elementor-widget elementor-widget-text-editor\" data-id=\"e9ef13b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Selon l\u2019article L6315 du Code du Travail, <\/span><span style=\"font-weight: 400;\">chaque salari\u00e9 doit b\u00e9n\u00e9ficier tous les 2 ans, d\u2019un entretien professionnel avec son employeur, pour aborder son parcours et ses perspectives d\u2019\u00e9volution au sein de l\u2019entreprise. Il s\u2019agit de rep\u00e9rer les salari\u00e9s qui pourraient \u00e9voluer dans leur poste, et de les informer sur leurs droits \u00e0 la formation.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">L\u2019entretien professionnel s\u2019adresse \u00e0 tous les\u00a0salari\u00e9s ayant au moins 2 ans d\u2019anciennet\u00e9\u00a0quels que soient :\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">leur type de contrat\u00a0: CDI, CDD, contrat d\u2019apprentissage et contrat de professionnalisation ;\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">leur cat\u00e9gorie socioprofessionnelle : cadre, agent de ma\u00eetrise, employ\u00e9, ouvrier ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">leur temps de travail\u00a0: temps partiel ou temps plein.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Tous les six ans, l&rsquo;entretien professionnel doit faire un \u00e9tat des lieux r\u00e9capitulatif du parcours professionnel du salari\u00e9. Cet entretien, \u00e9galement appel\u00e9 \u201cbilan des entretiens professionnels\u201d<\/span><span style=\"font-weight: 400;\"> permet de faire le point sur son parcours et s\u2019assurer notamment qu\u2019il :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a b\u00e9n\u00e9fici\u00e9 d\u2019action de formation ;\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a \u00e9volu\u00e9 professionnellement ou au niveau de la r\u00e9mun\u00e9ration ;\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a acquis des \u00e9l\u00e9ments de certification par la formation ou par une validation des acquis de l&rsquo;exp\u00e9rience.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">C\u2019est une obligation pour toutes les entreprises quel que soit leur effectif.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c70082 elementor-widget elementor-widget-heading\" data-id=\"8c70082\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Qui peut faire passer l\u2019entretien professionnel ? <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f38237e elementor-widget elementor-widget-text-editor\" data-id=\"f38237e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Le Code du Travail laisse libre choix \u00e0 l\u2019employeur de confier cette responsabilit\u00e9 aux \u00e9quipes RH, aux managers op\u00e9rationnels ou \u00e0 un repr\u00e9sentant de la direction, selon la taille et l\u2019organisation de l\u2019entreprise.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7bbd7f6 elementor-widget elementor-widget-heading\" data-id=\"7bbd7f6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Le salari\u00e9 peut-il refuser un entretien professionnel obligatoire ?\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4843b83 elementor-widget elementor-widget-text-editor\" data-id=\"4843b83\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">L\u2019entretien professionnel est obligatoire pour l\u2019employeur, mais il reste facultatif pour le salari\u00e9. Ce dernier a le droit de refuser de se pr\u00e9senter \u00e0 l\u2019entretien professionnel.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8d87c73 elementor-widget elementor-widget-heading\" data-id=\"8d87c73\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Comment faire dans ce cas ?\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c00b2f4 elementor-widget elementor-widget-text-editor\" data-id=\"c00b2f4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Il est recommand\u00e9 de convoquer le salari\u00e9 et de lui demander de motiver son refus par \u00e9crit (lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou remise contre d\u00e9charge) afin d\u2019en garder une trace et d\u2019\u00e9viter toute sanction.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">L\u2019entretien professionnel ne doit pas \u00eatre confondu avec l\u2019entretien d\u2019\u00e9valuation, qui a lieu chaque ann\u00e9e et vise \u00e0 mesurer l\u2019atteinte des objectifs annuels. Contrairement \u00e0 ce dernier, l\u2019entretien professionnel se concentre sur les perspectives d\u2019\u00e9volution du salari\u00e9 et l\u2019information sur ses droits \u00e0 la formation.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8df03bd elementor-widget elementor-widget-heading\" data-id=\"8df03bd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Quels sont les entretiens obligatoires ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6267f27 elementor-widget elementor-widget-heading\" data-id=\"6267f27\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">L\u2019entretien professionnel<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-24d9bb6 elementor-widget elementor-widget-text-editor\" data-id=\"24d9bb6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Selon l\u2019article L6315-1 du Code du travail, l\u2019employeur doit informer individuellement le salari\u00e9, d\u00e8s son embauche, qu\u2019il peut b\u00e9n\u00e9ficier d\u2019un entretien professionnel.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Une convocation formelle doit \u00eatre envoy\u00e9e au moins un mois avant la date pr\u00e9vue, pr\u00e9cisant la date, l\u2019heure et le lieu de l\u2019entretien.<\/span><\/p><p><span style=\"font-weight: 400;\">L\u2019entretien professionnel doit imp\u00e9rativement se d\u00e9rouler pendant les heures de travail effectives et dans les locaux de l\u2019entreprise.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Les entretiens professionnels ont pour but d\u2019aborder avec le salari\u00e9 ses possibilit\u00e9s d\u2019\u00e9volution professionnelle et les actions de formation dont il peut b\u00e9n\u00e9ficier.<\/span><\/p><p><span style=\"font-weight: 400;\">Durant l\u2019entretien professionnel, l\u2019employeur \u00e9voque avec le salari\u00e9 :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ses perspectives d\u2019\u00e9volution professionnelle ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les modalit\u00e9s d\u2019activation de son compte personnel de formation (CPF) ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">la possibilit\u00e9 de r\u00e9aliser la validation des acquis de l&rsquo;exp\u00e9rience (VAE) ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ses \u00e9ventuels besoins d\u2019accompagnement (formations, mentoring, coaching).<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Enfin, l\u2019entretien professionnel doit faire l\u2019objet d\u2019un compte rendu d\u00e9taill\u00e9, dont une copie est donn\u00e9e au salari\u00e9 \u00e0 l\u2019issue de l\u2019\u00e9change. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9570d9f elementor-widget elementor-widget-heading\" data-id=\"9570d9f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">L\u2019entretien de reprise d\u2019activit\u00e9 du salari\u00e9<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c30bcd0 elementor-widget elementor-widget-text-editor\" data-id=\"c30bcd0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Un entretien doit \u00e9galement \u00eatre propos\u00e9, apr\u00e8s un cong\u00e9 ou un arr\u00eat de longue dur\u00e9e afin de faciliter le retour du salari\u00e9. Cette obligation s\u2019applique aux situations suivantes :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un cong\u00e9 de maternit\u00e9 ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un cong\u00e9 de proche aidant ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un cong\u00e9 d\u2019adoption ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un cong\u00e9 parental d\u2019\u00e9ducation \u00e0 temps partiel ou \u00e0 temps plein ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un mandat syndical ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un arr\u00eat maladie de longue dur\u00e9e ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un cong\u00e9 de mobilit\u00e9 volontaire s\u00e9curis\u00e9e ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un cong\u00e9 sabbatique.<\/span><\/li><\/ul><p><br \/><span style=\"font-weight: 400;\">L\u2019<\/span><span style=\"font-weight: 400;\">entretien professionnel\u00a0 de reprise\u00a0<\/span><span style=\"font-weight: 400;\">permet au salari\u00e9 de\u00a0r\u00e9int\u00e9grer plus facilement son poste, de prendre connaissance des changements survenus pendant son absence et d\u2019identifier ses besoins potentiels en formation pour mettre \u00e0 jour ses comp\u00e9tences.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a3327ac elementor-widget elementor-widget-heading\" data-id=\"a3327ac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">L\u2019entretien individuel de forfait jours<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51cd95a elementor-widget elementor-widget-text-editor\" data-id=\"51cd95a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Dans le cadre d\u2019une convention de forfait jour, l\u2019entretien individuel est obligatoire.
