tenant compte des week-ends, cong\u00e9s pay\u00e9s et jours f\u00e9ri\u00e9s.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En cas d\u2019arr\u00eat 400;\">Pour rappel, une convention de forfait jours est un accord entre l\u2019employeur et le salari\u00e9 permettant de fixer une dur\u00e9e de travail diff\u00e9rente de la dur\u00e9e l\u00e9gale ou conventionnelle, en fonction d\u2019un nombre de jours travaill\u00e9s sur l\u2019ann\u00e9e.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Cette convention ne peut \u00eatre conclue qu\u2019en pr\u00e9sence d\u2019un accord collectif autorisant le recours au forfait jours et uniquement avec :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les cadres disposant d\u2019une autonomie dans l\u2019organisation de leur emploi du temps ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les salari\u00e9s non cadres qui exercent des responsabilit\u00e9s n\u00e9cessitant une r\u00e9elle autonomie dans la gestion de leur temps de travail (<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006189633\/\"><span style=\"font-weight: 400;\">Article L3121-58<\/span><span style=\"font-weight: 400;\"> du Code du travail<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Dans ce cas, le salari\u00e9 n\u2019est pas soumis aux 35 heures hebdomadaires et peut d\u00e9passer cette limite sans que cela soit consid\u00e9r\u00e9 comme des heures suppl\u00e9mentaires, puisque son temps de travail est comptabilis\u00e9 en jours et non en heures.<\/span><\/p><p><span style=\"font-weight: 400;\">En principe, le forfait correspond \u00e0 218 jours de travail par an (<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036262805\"><span style=\"font-weight: 400;\">article L3121-64 du Code du travail)<\/span><\/a><span style=\"font-weight: 400;\">. Au-del\u00e0 de cette limite, des jours de RTT doivent \u00eatre accord\u00e9s aux salari\u00e9s en forfait jours.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b77424b elementor-widget elementor-widget-heading\" data-id=\"b77424b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Comment calculer les RTT pour les cadres en forfait jour ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5b6f12 elementor-widget elementor-widget-text-editor\" data-id=\"f5b6f12\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Pour calculer le nombre de jours de RTT auxquels les salari\u00e9s en forfait jours peuvent pr\u00e9tendre, vous devez soustraire aux 365 jours de l\u2019ann\u00e9e :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les 218 jours travaill\u00e9s ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les week-ends ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les jours f\u00e9ri\u00e9s tombant sur des jours ouvr\u00e9s ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">25 jours de cong\u00e9s pay\u00e9s.<\/span><\/li><\/ul><table><tbody><tr><td><p><span style=\"font-weight: 400;\">RTT et arr\u00eat maladie<\/span><span style=\"font-weight: 400;\"> en forfait jours<\/span><\/p><p><span style=\"font-weight: 400;\">En cas d\u2019arr\u00eat maladie court (quelques jours ou semaines), les RTT sont en principe maintenus, car le forfait jours repose sur une logique annuelle. En principe, oui. Les salari\u00e9s en forfait jours b\u00e9n\u00e9ficient d\u2019une autonomie dans l\u2019organisation de leur temps de travail. De ce fait, l\u2019employeur ne peut pas leur imposer des plages horaires de pr\u00e9sence.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">D\u2019un point de vue l\u00e9gal, le <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006160755\/#:~:text=Version%20en%20vigueur%20au%2025%20mars%202025&amp;text=Tout%20salari%C3%A9%20b%C3%A9n%C3%A9ficie%20d'un,des%20conditions%20d%C3%A9termin%C3%A9es%20par%20d%C3%A9cret.\"><span style=\"font-weight: 400;\">Code du travail<\/span><\/a><span style=\"font-weight: 400;\"> impose \u00ab seulement \u00bb aux cadres en forfait jours de respecter les temps de repos obligatoires :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un repos quotidien d\u2019au moins 11 heures cons\u00e9cutives ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un repos hebdomadaire de 35 heures continues.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e94631 elementor-widget elementor-widget-heading\" data-id=\"1e94631\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Les exceptions pratiques\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f0f6d27 elementor-widget elementor-widget-text-editor\" data-id=\"f0f6d27\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Certaines conventions collectives ou certains accords d\u2019entreprise pr\u00e9cisent qu\u2019un jour travaill\u00e9 doit correspondre \u00e0 une pr\u00e9sence significative, souvent \u00e9quivalente \u00e0 une demi-journ\u00e9e ou une journ\u00e9e pleine.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Dans cette hypoth\u00e8se, un salari\u00e9 en forfait jours qui ne travaille que 3 heures pourrait \u00eatre tenu de poser un demi-RTT.
