data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Un arr\u00eat de travail peut impacter les jours de RTT, mais tout d\u00e9pend du mode de calcul appliqu\u00e9 dans l\u2019entreprise.<\/span><\/p><p><span style=\"font-weight: 400;\">Si l\u2019entreprise applique le mode de calcul par acquisition, les RTT sont directement li\u00e9s au temps de travail effectif. Autrement dit, moins de jours travaill\u00e9s = moins de RTT. Sauf si un accord collectif pr\u00e9voit une exception, chaque absence entra\u00eene donc une r\u00e9duction proportionnelle des jours de RTT.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Exemple : un salari\u00e9 en arr\u00eat pour maladie pendant une semaine sur un mois n\u2019accumulera des RTT que sur les trois semaines o\u00f9 il a effectivement travaill\u00e9.<\/span><\/p><p><span style=\"font-weight: 400;\">Mais attention, certaines situations \u00e9chappent \u00e0 cette r\u00e8gle :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">arr\u00eat faisant suite \u00e0 un accident du travail ou \u00e0 une maladie professionnelle : selon les accords en vigueur, il peut ne pas affecter l\u2019acquisition des RTT car il est assimil\u00e9 \u00e0 du temps de travail effectif ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">cong\u00e9 maternit\u00e9 : souvent comptabilis\u00e9 comme du temps de travail effectif, il n\u2019impacte pas les RTT.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">En revanche, dans une logique forfaitaire, c\u2019est un tout autre sc\u00e9nario. Les RTT sont fix\u00e9s d\u00e8s le d\u00e9but de l\u2019ann\u00e9e, sans lien avec le nombre de jours r\u00e9ellement travaill\u00e9s. R\u00e9sultat : un salari\u00e9 en arr\u00eat conserve l\u2019int\u00e9gralit\u00e9 de ses droits.<\/span><\/p><table><tbody><tr><td><span style=\"font-weight: 400;\">Bon \u00e0 savoir : attention \u00e0 ne pas confondre <\/span><span style=\"font-weight: 400;\">RTT et r\u00e9cup\u00e9ration<\/span><span style=\"font-weight: 400;\">. En principe, sauf disposition contraire pr\u00e9vue dans un accord collectif, il ne peut pas reporter ses RTT, que ceux-ci soit des <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/administration\/conges-et-absences\/rtt-imposes\"><span style=\"font-weight: 400;\">RTT impos\u00e9s<\/span><\/a><span style=\"font-weight: 400;\"> par l\u2019employeur ou librement planifi\u00e9s par lui-m\u00eame. Pourquoi ? Parce qu\u2019en droit du travail, c\u2019est la premi\u00e8re cause de suspension du contrat de travail qui pr\u00e9vaut.<\/span><\/p><p><span style=\"font-weight: 400;\">Concr\u00e8tement, lorsqu\u2019un salari\u00e9 pose des RTT, son contrat est d\u00e9j\u00e0 suspendu pour cause de repos. S\u2019il tombe malade durant cette p\u00e9riode, l\u2019arr\u00eat maladie ne remplace pas r\u00e9troactivement les RTT, car la suspension pour RTT a \u00e9t\u00e9 act\u00e9e en premier.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Notez toutefois que des exceptions peuvent exister. En effet, certains accords collectifs ou dispositions conventionnelles plus favorables peuvent pr\u00e9voir un report des RTT en cas d\u2019arr\u00eat maladie. Il est donc essentiel de v\u00e9rifier les r\u00e8gles applicables dans l\u2019entreprise.<\/span><\/p><p><span style=\"font-weight: 400;\">En r\u00e9sum\u00e9 ? L\u2019impact d\u2019un arr\u00eat maladie sur les RTT d\u00e9pend du mode de calcul et des r\u00e8gles en vigueur dans l\u2019entreprise. Un d\u00e9tail qui peut avoir des cons\u00e9quences directes sur la gestion des absences et de la paie. Pour \u00e9viter toute mauvaise surprise, vigilance et anticipation sont de mise : avant toute d\u00e9cision, consultez les accords collectifs et la convention applicable.
