Un de ces arr\u00eats acte\u00a0 la n\u00e9cessit\u00e9 de <\/span><b>prendre en compte les cong\u00e9s pay\u00e9s dans le calcul du seuil de d\u00e9clenchement des heures aria-level=\"1\"><span style=\"font-weight: 400;\">Lorsqu\u2019un salari\u00e9 prend des cong\u00e9s pay\u00e9s, ces jours doivent \u00eatre assimil\u00e9s \u00e0 du temps de travail effectif pour le calcul des heures suppl\u00e9mentaires.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Concr\u00e8tement, les cong\u00e9s pay\u00e9s peuvent d\u00e9clencher le d\u00e9passement du seuil des <\/span><b>35 heures hebdomadaires<\/b><span style=\"font-weight: 400;\"> et g\u00e9n\u00e9rer ainsi des heures suppl\u00e9mentaires, donc des majorations.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L\u2019arr\u00eat ne concerne que les salari\u00e9s en d\u00e9compte hebdomadaire, donc pas les collaborateurs en annualisation ou mensualisation du temps de class=\"elementor-element elementor-element-3c2e077 elementor-widget elementor-widget-text-editor\" data-id=\"3c2e077\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Jusqu\u2019ici, les cong\u00e9s pay\u00e9s n\u2019\u00e9taient pas pris en compte dans le calcul des heures suppl\u00e9mentaires.<\/span><\/p><p><span style=\"font-weight: 400;\">Par exemple, un collaborateur \u00e0 35h posait son lundi en cong\u00e9s pay\u00e9s, il devait donc r\u00e9aliser 28h sur la semaine. Si ce collaborateur travaillait en r\u00e9alit\u00e9 30h, les 2 heures en plus \u00e9taient bien pay\u00e9es mais non major\u00e9es.<\/span><\/p><p><span style=\"font-weight: 400;\">Or, la Cour de cassation, au nom de la primaut\u00e9 du droit europ\u00e9en, juge que les cong\u00e9s pay\u00e9s doivent entrer dans le calcul des heures suppl\u00e9mentaires, leur exclusion pouvant entra\u00eener une perte financi\u00e8re dissuadant les salari\u00e9s de prendre leur repos.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5812dbd :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Revoir le calcul des heures suppl\u00e9mentaires<\/b><span style=\"font-weight: 400;\"> : inclure les p\u00e9riodes de cong\u00e9s pay\u00e9s dans le d\u00e9compte hebdomadaire.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Adapter les logiciels de paie et de gestion des temps<\/b><span style=\"font-weight: 400;\">, afin que les compteurs refl\u00e8tent correctement la r\u00e8gle.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li><\/ul><p><b>Anticiper l\u2019impact financier<\/b><span style=\"font-weight: 400;\">, puisque d\u00e9sormais, les jours de cong\u00e9s pay\u00e9s comptent pour atteindre le seuil des 35 h, ce qui peut d\u00e9clencher le paiement d\u2019heures suppl\u00e9mentaires qui n\u2019\u00e9taient pas r\u00e9mun\u00e9r\u00e9es
