\n<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a021e6b elementor-widget elementor-widget-text-editor\" data-id=\"1a021e6b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Si un collaborateur est arr\u00eat\u00e9 alors qu\u2019il \u00e9tait en cong\u00e9, il doit pouvoir reporter \u00e0 plus tard la p\u00e9riode co\u00efncidant \u00e0 l\u2019arr\u00eat de travail.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\">Le report doit \u00eatre effectu\u00e9 via un recr\u00e9dit du compte de cong\u00e9s pay\u00e9s (c\u2019est \u00e0 dire que les cong\u00e9s ne doivent pas \u00eatre pris absolument juste apr\u00e8s l\u2019arr\u00eat de travail).<\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Il est fortement recommand\u00e9 d\u2019appliquer cette d\u00e9cision d\u00e8s maintenant, en attendant que cette d\u00e9cision soit transpos\u00e9e dans le Code du Travail.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2a253ed e-flex distincts<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-06321ee elementor-widget elementor-widget-text-editor\" data-id=\"06321ee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Jusqu\u2019alors, un salari\u00e9 qui tombait malade pendant ses cong\u00e9s ne voyait pas son arr\u00eat reconnu : les cong\u00e9s continuaient \u00e0 courir. Or cette position qui \u00e9mane du droit fran\u00e7ais n\u2019est pas align\u00e9e avec les r\u00e8gles europ\u00e9ennes.<\/span><\/p><p><span style=\"font-weight: 400;\">En effet, selon le droit de l\u2019Union europ\u00e9enne, l\u2019objectif du cong\u00e9 pay\u00e9 est certes de permettre aux salari\u00e9s de se reposer, mais aussi de profiter d&rsquo;une p\u00e9riode de d\u00e9tente et de loisirs. Alors qu\u2019un arr\u00eat de travail doit permettre au collaborateur de se r\u00e9tablir d&rsquo;un probl\u00e8me de sant\u00e9.<\/span><\/p><p>\u00a0<\/p><p><b>La Cour de cassation consid\u00e8re qu\u2019un arr\u00eat maladie emp\u00eache le salari\u00e9 de b\u00e9n\u00e9ficier r\u00e9ellement de son repos, et donc que les cong\u00e9s pay\u00e9s non utilis\u00e9s pendant cette p\u00e9riode doivent \u00eatre report\u00e9s.<\/b><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-224d8f4 elementor-widget elementor-widget-heading\" data-id=\"224d8f4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Comment g\u00e9rer cette nouvelle r\u00e8gle dans son entreprise ?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7076061 elementor-widget elementor-widget-text-editor\" data-id=\"7076061\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Pour les services RH, ce changement implique d\u2019adapter la gestion des absences :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">S\u2019assurer que les \u00e9quipes RH tiennent compte de cette mise \u00e0 jour pour int\u00e9grer la suspension des cong\u00e9s en cas d\u2019arr\u00eat maladie.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\">Ajuster le param\u00e9trage des logiciels de gestion des cong\u00e9s et de temps temps afin que le <b>report des cong\u00e9s pay\u00e9s en cas de maladie<\/b><span> se fasse automatiquement.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-437b913 elementor-widget elementor-widget-heading\" data-id=\"437b913\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Les questions que vous vous posez\u2026 et nous aussi\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-133b256 elementor-widget elementor-widget-text-editor\" data-id=\"133b256\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Comme en 2024 avec<\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/administration\/conges-et-absences\/arret-et-conge-nouvelles-regles\"><span style=\"font-weight: 400;\"> l\u2019acquisition et le report<\/span><\/a><span style=\"font-weight: 400;\"> des cong\u00e9s pay\u00e9s pendant un arr\u00eat maladie, la Cour de cassation clarifie certains points mais nous laisse en suspens pour d\u2019autres.
