Il doit cependant s\u2019astreindre \u00e0 certaines obligations comme le fait d\u2019en informer son personnel : au moment de l\u2019embauche, sur le lieu de travail, ou encore via des documents disponibles par tous et \u00e0 tout moment via un intranet ou un <\/span><a href=\"https:\/\/www.lucca.fr\/conges-et-absences\/\"><span style=\"font-weight: 400\">outil de gestion des cong\u00e9s et absences<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p><p>Dans les deux cas, si le salari\u00e9 souhaite ne pas travailler un jour f\u00e9ri\u00e9 d\u00e9clar\u00e9 non ch\u00f4m\u00e9 par l\u2019entreprise ou l\u2019accord de branche,<b> il doit faire une demande de cong\u00e9s traditionnelle.\u00a0<\/b><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-99d125b elementor-widget elementor-widget-heading\" data-id=\"99d125b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Comment organiser le planning et les d\u00e9parts en cong\u00e9s de ses salari\u00e9s pendant des p\u00e9riodes festives ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47d852c elementor-widget elementor-widget-text-editor\" data-id=\"47d852c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400\">Dans la pratique, on observe trois grandes tendances.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ee0378 elementor-widget elementor-widget-heading\" data-id=\"1ee0378\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">L\u2019entreprise fixe des cong\u00e9s obligatoires \u00e0 ses salari\u00e9s et ferme son site d\u2019exploitation pendant un temps d\u00e9termin\u00e9<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-296acce elementor-widget elementor-widget-text-editor\" data-id=\"296acce\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400\">Par exemple au moment des f\u00eates de No\u00ebl ou des cong\u00e9s d\u2019\u00e9t\u00e9. Cette p\u00e9riode de fermeture ne doit cependant pas d\u00e9passer 24 jours ouvrables, soit 4 semaines. N\u00e9anmoins, il faut permettre aux salari\u00e9s d\u2019acc\u00e9der \u00e0 un planning partag\u00e9, comme c\u2019est le cas via un <\/span><span style=\"font-weight: 400;\">logic<\/span><span style=\"font-weight: 400;\">i<\/span><span style=\"font-weight: 400;\">el de cong\u00e9s et absences<\/span><span style=\"font-weight: 400;\">, pour fluidifier l\u2019organisation interne des d\u00e9parts en cong\u00e9s.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6af78e elementor-widget elementor-widget-heading\" data-id=\"a6af78e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">L\u2019entreprise met en place un pr\u00e9visionnel annuel<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-897c85e elementor-widget elementor-widget-text-editor\" data-id=\"897c85e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>L\u2019employeur r\u00e9partit \u00e9quitablement les cong\u00e9s entre les salari\u00e9s \u00e0 l\u2019aide d\u2019un pr\u00e9visionnel. C\u2019est g\u00e9n\u00e9ralement au manager que revient<strong> le soin d\u2019arbitrer d\u2019\u00e9ventuels conflits entre salari\u00e9s<\/strong>. Ce sera le cas le samedi 15 ao\u00fbt et le dimanche 1er novembre.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fb4757d elementor-widget elementor-widget-heading\" data-id=\"fb4757d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Le jour f\u00e9ri\u00e9 est ch\u00f4m\u00e9 et tombe un jour travaill\u00e9 dans l\u2019entreprise<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d949f9a elementor-widget elementor-widget-text-editor\" data-id=\"d949f9a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Hors 1<sup>er<\/sup> mai, la r\u00e9mun\u00e9ration d\u00e9pend de l\u2019anciennet\u00e9 et du type de contrat du salari\u00e9. En effet, seuls les salari\u00e9s de plus de 3 mois d\u2019anciennet\u00e9 (travailleurs saisonniers compris) b\u00e9n\u00e9ficient du maintien de leur r\u00e9mun\u00e9ration, sans majoration pour l\u2019employeur sauf accords de branche sp\u00e9cifiques.<\/p>\n<p>Les personnes travaillant \u00e0 domicile, salari\u00e9s intermittents, ou salari\u00e9s temporaires ne sont toutefois pas concern\u00e9s par cette mesure et ne b\u00e9n\u00e9ficient quant \u00e0 eux d\u2019aucune r\u00e9mun\u00e9ration lors de ce jour ch\u00f4m\u00e9.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e52abb6 elementor-widget elementor-widget-heading\" data-id=\"e52abb6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">L\u2019exception du 1<sup>er<\/sup> mai<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d91645c elementor-widget elementor-widget-text-editor\" data-id=\"d91645c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tLa r\u00e9mun\u00e9ration est maintenue pour tous les salari\u00e9s, qu\u2019importe leur anciennet\u00e9 si le jour f\u00e9ri\u00e9 est ch\u00f4m\u00e9.
