La confusion est fr\u00e9quente. Mais la r\u00e8gle est la m\u00eame que pour les <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/talents\/remuneration\/ticket-restaurant-conges-payes](https:\/\/www.lucca.fr\/magazine\/talents\/remuneration\/ticket-restaurant-conges-payes\"><span style=\"font-weight: 400;\">titres-restaurant et les cong\u00e9s pay\u00e9s<\/span><\/a><span style=\"font-weight: 400;\"> : pas de jour de travail effectif, pas de titre.<\/span><\/p><p><span style=\"font-weight: 400;\">Le contrat de travail \u00e9tant l\u00e9galement suspendu, le droit aux titres l&rsquo;est aussi, peu importe l&rsquo;indemnisation. au jour de travail effectif, or le cong\u00e9 maternit\u00e9 suspend le contrat de travail.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ce principe est le m\u00eame que pour les cong\u00e9s pay\u00e9s ou les arr\u00eats maladie.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Des exceptions existent : un accord d&rsquo;entreprise, un usage ou une convention collective Il est donc indispensable de v\u00e9rifier :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">la convention collective applicable \u00e0 votre secteur ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un \u00e9ventuel accord d&rsquo;entreprise qui pr\u00e9voit le maintien de cet avantage ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">une d\u00e9cision unilat\u00e9rale de l&#8217;employeur (DUE) ou un usage d&rsquo;entreprise.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Ce maintien de l&rsquo;avantage n&rsquo;est pas interdit, mais il doit \u00eatre pr\u00e9vu express\u00e9ment dans l&rsquo;un des documents list\u00e9s ci-dessus. La r\u00e8gle ne concerne que l&rsquo;attribution de nouveaux titres, pas l&rsquo;utilisation de ceux d\u00e9j\u00e0 acquis.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Une salari\u00e9e peut donc tout \u00e0 fait utiliser les titres-restaurant qu&rsquo;elle a acquis lors de ses mois de travail pr\u00e9c\u00e9dents, qu&rsquo;ils soient sur une carte ou en format papier. L\u2019employeur doit donc v\u00e9rifier sa convention collective (ou accord d&rsquo;entreprise) pour d&rsquo;\u00e9ventuelles dispositions plus favorables.
