Cet \u00e9lan de solidarit\u00e9 a inspir\u00e9 la<strong> loi Mathys du 9 mai 2014<\/strong>, qui encadre aujourd\u2019hui le don de jours de repos entre coll\u00e8gues. Initialement limit\u00e9 aux parents d\u2019un enfant de moins de 20 ans gravement malade (loi Mathys du 9 mai 2014), le dispositif a depuis \u00e9t\u00e9 \u00e9tendu aux <strong data-start=\"876\" data-end=\"896\">salari\u00e9s aidants<\/strong> accompagnant un proche en perte d\u2019autonomie ou en situation de handicap.<\/p><p data-start=\"976\" data-end=\"1386\"><br \/>En parall\u00e8le, la <strong data-start=\"993\" data-end=\"1036\">loi de finances rectificative pour 2022<\/strong> a introduit une nouvelle possibilit\u00e9 : la <strong data-start=\"1079\" data-end=\"1112\">mon\u00e9tisation des RTT non pris<\/strong>. Dans ce cas, le salari\u00e9 ne fait pas don de ses jours, mais peut <strong data-start=\"1178\" data-end=\"1228\">demander \u00e0 son employeur de se les faire payer<\/strong>. Ces jours sont alors <strong data-start=\"1251\" data-end=\"1297\">r\u00e9mun\u00e9r\u00e9s comme des heures suppl\u00e9mentaires<\/strong>, avec un <strong data-start=\"1307\" data-end=\"1345\">r\u00e9gime fiscal et social avantageux<\/strong> (exon\u00e9rations dans certaines limites).<\/p><p data-start=\"1391\" data-end=\"1468\"><br \/>Le don et la mon\u00e9tisation des RTT r\u00e9pondent \u00e0 deux logiques distinctes :<\/p><ul data-start=\"1471\" data-end=\"1620\"><li data-start=\"1471\" data-end=\"1532\"><p data-start=\"1473\" data-end=\"1532\"><strong data-start=\"1473\" data-end=\"1490\">La solidarit\u00e9<\/strong> (donner ses jours \u00e0 un coll\u00e8gue aidant)<\/p><\/li><li data-start=\"1535\" data-end=\"1618\"><p data-start=\"1537\" data-end=\"1618\"><strong data-start=\"1537\" data-end=\"1575\">La valorisation du temps travaill\u00e9<\/strong> (transformer ses jours en r\u00e9mun\u00e9ration).<\/p><\/li><\/ul><p data-start=\"1623\" data-end=\"1725\">Chaque entreprise peut choisir d\u2019encadrer l\u2019un ou l\u2019autre ou bien les deux dans sa politique de cong\u00e9s.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8611e99 elementor-widget elementor-widget-heading\" data-id=\"8611e99\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Comment organiser le don et la mon\u00e9tisation de RTT dans son entreprise ?\u00a0<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b151d28 elementor-widget elementor-widget-text-editor\" data-id=\"b151d28\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Lancer la campagne de solidarit\u00e9, expliquer la proc\u00e9dure aux salari\u00e9s, centraliser les dons de cong\u00e9s, mettre \u00e0 jour les compteurs, obtenir l\u2019accord de la direction pour transf\u00e9rer les cong\u00e9s sur le compteur du b\u00e9n\u00e9ficiaire, transmettre les informations au gestionnaire de paie\u2026 Mettre en place un dispositif de <strong data-start=\"680\" data-end=\"687\">don<\/strong> ou de <strong data-start=\"694\" data-end=\"710\">mon\u00e9tisation<\/strong> de RTT demande un minimum d\u2019organisation. Voici comment fluidifier le processus.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a594f12 elementor-widget elementor-widget-heading\" data-id=\"a594f12\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Communiquer la proc\u00e9dure de don ou de mon\u00e9tisation des RTT aupr\u00e8s de l\u2019ensemble des collaborateurs<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-54c19c8 elementor-widget elementor-widget-text-editor\" data-id=\"54c19c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Il convient d\u2019indiquer clairement la marche \u00e0 suivre pour proc\u00e9der \u00e0 un <strong data-start=\"664\" data-end=\"671\">don<\/strong> ou \u00e0 une <strong data-start=\"681\" data-end=\"708\">demande de mon\u00e9tisation<\/strong> de RTT dans la politique de cong\u00e9s et d\u2019absences de l\u2019entreprise. Ce document doit \u00eatre accessible \u00e0 tous, via un affichage, un dossier partag\u00e9 ou encore un <\/span><a href=\"https:\/\/www.lucca.fr\/conges-et-absences\/\"><span style=\"font-weight: 400;\">logiciel de gestion des cong\u00e9s et absences<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Vous pourrez y d\u00e9tailler :<br \/><\/span><\/p><ul><li data-start=\"948\" data-end=\"1059\"><p data-start=\"950\" data-end=\"1059\">les jours concern\u00e9s : RTT, jours de r\u00e9cup\u00e9ration ou jours \u00e9pargn\u00e9s dans un <strong data-start=\"1025\" data-end=\"1055\">compte \u00e9pargne temps (CET)<\/strong> ;<\/p><\/li><li data-start=\"1060\" data-end=\"1436\"><p data-start=\"1062\" data-end=\"1109\">la proc\u00e9dure applicable selon le dispositif :<\/p><ul data-start=\"1112\" data-end=\"1436\"><li data-start=\"1112\" data-end=\"1245\"><p data-start=\"1114\" data-end=\"1245\"><strong data-start=\"1114\" data-end=\"1129\">pour le don<\/strong> : modalit\u00e9s de lancement de la campagne, circuits de validation, anonymat et volontariat des salari\u00e9s donateurs ;<\/p><\/li><li data-start=\"1248\" data-end=\"1436\"><p data-start=\"1250\" data-end=\"1436\"><strong data-start=\"1250\" data-end=\"1274\">pour la mon\u00e9tisation<\/strong> : conditions d\u2019\u00e9ligibilit\u00e9 (p\u00e9riode, nombre de jours concern\u00e9s), proc\u00e9dure d\u2019accord entre le salari\u00e9 et l\u2019employeur, et r\u00e8gles de traitement fiscal et social ;<\/p><\/li><\/ul><\/li><li>les engagements communs \u00e0 respecter : tra\u00e7abilit\u00e9, transparence et \u00e9quit\u00e9 entre les salari\u00e9s.<\/li><\/ul><p><strong>Bon \u00e0 savoir :<\/strong> ces deux dispositifs peuvent coexister dans la m\u00eame politique RH, \u00e0 condition que leurs modalit\u00e9s soient bien distingu\u00e9es pour \u00e9viter toute confusion.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5131c40 elementor-widget elementor-widget-spacer\" data-id=\"5131c40\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t<div class=\"elementor-element elementor-element-93f5188 e-flex e-con-boxed e-con e-parent\" data-id=\"93f5188\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9f7a727 elementor-widget elementor-widget-spacer\" data-id=\"9f7a727\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2e24b48 elementor-alert-info elementor-widget elementor-widget-alert\" data-id=\"2e24b48\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\t\t\t<span class=\"elementor-alert-title\">Conseil : Demander l\u2019accord du b\u00e9n\u00e9ficiaire avant de lancer la campagne<\/span>\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">Certains collaborateurs ne souhaitent pas attirer l'attention de leurs coll\u00e8gues sur la situation difficile qu\u2019ils vivent. Demandez leur accord avant de lancer toute campagne de solidarit\u00e9.\u00a0\n\nSp\u00e9cifiez \u00e9galement \u00e0 l\u2019ensemble des collaborateurs que les dons se font uniquement sur la base du volontariat.
