La question des RTT d\u00e9pend de deux crit\u00e8res : la pr\u00e9sence d\u2019un accord collectif et la capacit\u00e9 du salari\u00e9 \u00e0 prendre r\u00e9ellement ses sommes qui doivent \u00eatre vers\u00e9es au salari\u00e9 \u00e0 la date de son dernier jour dans l\u2019entreprise. Les <strong>cong\u00e9s pay\u00e9s<\/strong> et les<strong> RTT<\/strong>, quand ils existent, tiennent une place centrale dans le document. <br \/>Le <strong>solde de tout compte<\/strong> comprend :<\/p><ul><li>le <strong>salaire<\/strong> ;<\/li><li>les primes ;<\/li><li>les indemnit\u00e9s de <strong>rupture du contrat<\/strong> ;<\/li><li>les <strong>cong\u00e9s pay\u00e9s<\/strong> ;<\/li><li>les cong\u00e9s d\u2019anciennet\u00e9.<\/li><\/ul><p><span style=\"text-decoration: underline;\"><strong><br \/>Bon \u00e0 savoir<\/strong><\/span> : \u00e0 noter que pendant la p\u00e9riode d&rsquo;un pr\u00e9avis de licenciement les r\u00e8gles de cong\u00e9s varient. Si l\u2019accord collectif pr\u00e9voit l\u2019indemnisation des jours de <strong>RTT<\/strong> non pris, un accord de branche ou d\u2019entreprise peut pr\u00e9voir le versement d\u2019une <strong>indemnit\u00e9<\/strong> compensatrice.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bae7f6c elementor-widget elementor-widget-heading\" data-id=\"bae7f6c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2. Cependant, si l\u2019<strong>employeur<\/strong> n\u2019avait pas permis au <strong>salari\u00e9<\/strong> d\u2019utiliser les<strong> jours de RTT<\/strong>, la jurisprudence indique que \u00a0la non prise des jours de <strong>RTT<\/strong> est \u00ab imputable \u00e0 l\u2019employeur \u00bb. Dans ce cas, l\u2019<strong>indemnit\u00e9<\/strong> compensatrice est alors due.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-034ca37 elementor-widget elementor-widget-heading\" data-id=\"034ca37\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Le salari\u00e9 peut contester le d\u00e9compte des cong\u00e9s et des RTT<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-afebc02 elementor-widget elementor-widget-text-editor\" data-id=\"afebc02\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pour pacifier la rupture d\u2019un <strong>contrat<\/strong> de <strong>travail<\/strong>, qui soit du fait de l\u2019<strong>employeur<\/strong> ou du <strong>salari\u00e9<\/strong>, la tenue de compteurs partag\u00e9s entre l\u2019<strong>employeur<\/strong> et le <strong>salari\u00e9<\/strong> est d\u00e9cisive. La signature par le<strong> salari\u00e9<\/strong> du <strong>solde de tout compte<\/strong> n\u2019a pas valeur d\u2019acquiescement.<\/p>\n<p>M\u00eame s\u2019il signe le solde de tout compte, un <strong>salari\u00e9<\/strong> dispose de 6 mois pour contester son contenu et r\u00e9clamer un arri\u00e9r\u00e9 de <strong>salaire<\/strong> ou de <strong>cong\u00e9s pay\u00e9s<\/strong>.
