les cong\u00e9s qu\u2019il acquiert chaque mois au fur et \u00e0 mesure, sans attendre le d\u00e9but de la p\u00e9riode de prise de cong\u00e9s qui est fix\u00e9e g\u00e9n\u00e9ralement au 1<sup>er<\/sup>\u00a0mai.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d857b27 elementor-widget elementor-widget-heading\" data-id=\"d857b27\" elementor-size-default\">Prendre ses cong\u00e9s par anticipation est un droit<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05d3d75 elementor-widget class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Les r\u00e8gles de\u00a0gestion des cong\u00e9s\u00a0ont chang\u00e9 depuis le 1<sup>er<\/sup>\u00a0janvier 2017 :<\/p><ul><li><strong>Avant le 1<sup>er<\/sup>\u00a0janvier 2017 :<\/strong>\u00a0Un nouvel embauch\u00e9 devait attendre la fin de la p\u00e9riode d\u2019acquisition des cong\u00e9s, g\u00e9n\u00e9ralement fix\u00e9e au 31 mai, pour prendre des vacances. L\u2019anticipation \u00e9tait alors une facilit\u00e9 accord\u00e9e par l\u2019employeur.<\/li><li><b>Depuis le 1<sup>er<\/sup>\u00a0janvier 2017 :<\/b>\u00a0Le salari\u00e9 a le droit de prendre ses cong\u00e9s d\u00e8s qu\u2019il les a acquis. Si le\u00a0salari\u00e9 int\u00e8gre l\u2019entreprise au 1<sup>er<\/sup>\u00a0mars, il acquiert durant ce mois 2,08 jours de cong\u00e9 ouvr\u00e9s (ou 2,5 jours ouvrables). Il lui est d\u00e9sormais possible de formuler une demande de cong\u00e9s d\u00e8s le 1<sup>er<\/sup>\u00a0avril.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e89f906 elementor-widget elementor-widget-heading\" data-id=\"e89f906\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">L\u2019anticipation ne peut \u00eatre le motif du refus<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-809facd elementor-widget elementor-widget-text-editor\" data-id=\"809facd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Le droit de prendre ses cong\u00e9s par anticipation ne dispense pas le salari\u00e9 d\u2019obtenir l\u2019accord de l\u2019employeur, comme pour toute prise de cong\u00e9s. L\u2019entreprise peut toujours refuser une demande de cong\u00e9s si la d\u00e9cision est justifi\u00e9e par l\u2019activit\u00e9 de l\u2019entreprise ou l\u2019ordre des d\u00e9parts fix\u00e9 dans l\u2019entreprise. Mais d\u00e9sormais,\u00a0le fait que le cong\u00e9 soit pris par anticipation ne peut pas \u00eatre le motif du refus invoqu\u00e9 par l\u2019employeur.<\/p><p>L\u2019anticipation est un droit pour le nouvel embauch\u00e9.
