Rares sont les entreprises fran\u00e7aises qui ont tent\u00e9 l\u2019exp\u00e9rience et \u00e0 raison. A cela s&rsquo;ajoutent les RTT pour les salari\u00e9s r\u00e9alisant plus de 35 heures par semaine, les <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/administration\/conges-et-absences\/conges-speciaux\"><span style=\"font-weight: 400;\">cong\u00e9s sp\u00e9ciaux<\/span><\/a><span style=\"font-weight: 400;\"> (cong\u00e9 parental, d\u00e9c\u00e8s, sabbatique\u2026) ou encore les <\/span><span style=\"font-weight: 400;\">cong\u00e9s autoris\u00e9s par le droit local<\/span><span style=\"font-weight: 400;\"> ou des conventions collectives et accords de branche. Pour mettre en place les cong\u00e9s illimit\u00e9s dans une entreprise fran\u00e7aise, il faut donc <\/span><a href=\"https:\/\/www.lucca.fr\/magazine\/administration\/conges-et-absences\/conges-offerts-par-lemployeur\"><span style=\"font-weight: 400;\">offrir des jours d\u2019absences suppl\u00e9mentaires<\/span><\/a><span style=\"font-weight: 400;\"> aux cong\u00e9s pr\u00e9vus par la loi.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e8a696 elementor-widget elementor-widget-text-editor\" data-id=\"1e8a696\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Cette pratique est autoris\u00e9e. Elle doit n\u00e9anmoins concerner l\u2019ensemble des collaborateurs ou une cat\u00e9gorie d\u00e9termin\u00e9e d\u2019entre eux pour respecter le devoir d\u2019\u00e9galit\u00e9 de traitement et de r\u00e9mun\u00e9ration entre les salari\u00e9s. A d\u00e9faut, un salari\u00e9 serait en droit, en cas de conflit prudhommal de jouer l&rsquo;argument de discrimination.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93f8885 elementor-widget elementor-widget-heading\" data-id=\"93f8885\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Les limites organisationnelles d\u2019une politique de cong\u00e9s illimit\u00e9s<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3aecc4e elementor-widget elementor-widget-text-editor\" data-id=\"3aecc4e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Les cong\u00e9s illimit\u00e9s sont principalement mis en place dans des petites structures qui pr\u00e9sentent peu de niveaux hi\u00e9rarchiques et qui vantent leur esprit \u201cstart-up\u201d (ex: PopChef, Yes We Dev, Indeed). Cette politique concerne des m\u00e9tiers qui ne n\u00e9cessitent pas un temps de pr\u00e9sence continu, indispensable \u00e0 l\u2019activit\u00e9 de l\u2019entreprise (ex : charg\u00e9 d&rsquo;accueil, responsable de SAV, m\u00e9tiers sur site de production).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-70292bb elementor-widget elementor-widget-heading\" data-id=\"70292bb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Des cong\u00e9s illimit\u00e9s soumis \u00e0 conditions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-24ff3f6 elementor-widget elementor-widget-text-editor\" data-id=\"24ff3f6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">La prise des cong\u00e9s illimit\u00e9s ne peut \u00eatre totalement libre pour ne pas entraver le bon fonctionnement de l\u2019entreprise.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b14103f elementor-widget elementor-widget-text-editor\" data-id=\"b14103f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Les entreprises comme Yes We Dev, Indeed ou encore PopChef ont par ailleurs mis en place des conditions d\u2019acc\u00e8s pour b\u00e9n\u00e9ficier de cong\u00e9s au del\u00e0 du seuil l\u00e9gal :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les objectifs individuels doivent \u00eatre atteints \u00e0 100%,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le reste de l\u2019\u00e9quipe doit donner son accord pour des cong\u00e9s longs,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le salari\u00e9 doit avoir au moins 2 ans d\u2019anciennet\u00e9,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le nombre de jours de cong\u00e9s suppl\u00e9mentaires est limit\u00e9,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le salari\u00e9 doit respecter un d\u00e9lai de pr\u00e9venance.<\/span><\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-188965b elementor-widget elementor-widget-heading\" data-id=\"188965b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Les d\u00e9rives des cong\u00e9s illimit\u00e9s<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7506d29 elementor-widget elementor-widget-text-editor\" data-id=\"7506d29\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Les adeptes des cong\u00e9s illimit\u00e9s vantent les atouts de cette pratique pour la Qualit\u00e9 de Vie au Travail et la marque employeur.
