L\u2019objectif est de r\u00e9duire, sur une dur\u00e9e d\u00e9termin\u00e9e, les charges de personnel pour \u00e9viter de proc\u00e9der \u00e0 des ruptures de contrats (licenciements \u00e9conomiques, non renouvellement de contrats, fin de p\u00e9riode d\u2019essai\u2026). style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">restructuration de la soci\u00e9t\u00e9,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">perte cons\u00e9quente d\u2019activit\u00e9,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">difficult\u00e9 d\u2019approvisionnement,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">impossibilit\u00e9 de mettre en place les mesures de pr\u00e9vention n\u00e9cessaires pour la protection de la sant\u00e9 des salari\u00e9s, etc.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element d\u00e9marche, l\u2019entreprise doit informer le CSE le motif de la demande d\u2019activit\u00e9 partielle et la liste des salari\u00e9s concern\u00e9s.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eae69c5 elementor-widget elementor-widget-heading\" data-id=\"eae69c5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\"> Aupr\u00e8s de la Direccte<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5439bfd elementor-widget elementor-widget-text-editor\" data-id=\"5439bfd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">L\u2019entreprise peut ensuite faire sa <\/span><span style=\"font-weight: 400;\">demande en ligne<\/span><span style=\"font-weight: 400;\"> sur le site de la Direccte en sp\u00e9cifiant notamment le nombre de salari\u00e9s concern\u00e9s, les d\u00e9partements ou cat\u00e9gories socio-professionnelles impact\u00e9s, une estimation du nombre d\u2019heures ch\u00f4m\u00e9es\u2026 \u00c0 noter que les salari\u00e9s prot\u00e9g\u00e9s ne peuvent \u00eatre mis en ch\u00f4mage partiel sans leur accord \u00e9crit.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Sans r\u00e9ponse de l\u2019administration dans les 15 jours, la demande est consid\u00e9r\u00e9e comme approuv\u00e9e et valable 6 mois. L\u2019entreprise re\u00e7oit ensuite des codes lui permettant de d\u00e9clarer ses salari\u00e9s en activit\u00e9 partielle toutes les semaines. Dans le cas contraire, la Direccte motive sa d\u00e9cision en d\u00e9taillant les raisons du refus.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Attention, lors du d\u00e9p\u00f4t du dossier, votre demande doit \u00eatre s\u00e9rieusement motiv\u00e9e (voir conseil 2 et 5).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6dbabfa elementor-widget elementor-widget-heading\" data-id=\"6dbabfa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Prise en charge du salaire des collaborateurs en ch\u00f4mage partiel<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-536b3ad elementor-widget elementor-widget-text-editor\" data-id=\"536b3ad\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">La prise en charge de la r\u00e9mun\u00e9ration des salari\u00e9s en ch\u00f4mage partiel d\u00e9pend de deux cas de figure.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e2555bb elementor-widget elementor-widget-heading\" data-id=\"e2555bb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Dans le cadre d\u2019une activit\u00e9 partielle <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-64e987a elementor-widget elementor-widget-text-editor\" data-id=\"64e987a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">L\u2019entreprise s\u2019acquitte normalement des heures travaill\u00e9es et d\u00e9dommage les heures ch\u00f4m\u00e9es des salari\u00e9s concern\u00e9s \u00e0 hauteur de 70 % de leur r\u00e9mun\u00e9ration horaire ant\u00e9rieure brute.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-07f4050 elementor-widget elementor-widget-heading\" data-id=\"07f4050\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Dans le cadre d\u2019un arr\u00eat complet du travail<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78bc1e3 elementor-widget elementor-widget-text-editor\" data-id=\"78bc1e3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">L\u2019entreprise verse un d\u00e9dommagement aux salari\u00e9s correspondant \u00e0 70 % de leur r\u00e9mun\u00e9ration horaire ant\u00e9rieure brute au lieu de leur salaire habituel.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Dans les deux cas, l\u2019entreprise re\u00e7oit le versement d\u2019une allocation d\u2019activit\u00e9 partielle cofinanc\u00e9e par l\u2019Etat et l\u2019Un\u00e9dic. Cette allocation est plafonn\u00e9e \u00e0 1 000 heures par an et par salari\u00e9. L\u2019employeur a la possibilit\u00e9 d\u2019indemniser \u00e0 sa charge ses salari\u00e9s au-del\u00e0 de 70 % du salaire brut s\u2019il le souhaite ou s\u2019il en a la possibilit\u00e9.
